Acceptance of terms

These Terms and Conditions (the "Terms") govern access to and use of North Craft Foundry Inc.'s services, including our on-demand 3D printing services and the EngiNova preparation tool (collectively, the "Services"). By creating an account, placing an order, or submitting any file through the Services you agree to be bound by these Terms and all policies referenced herein.

If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization and that references to "you" or "your" include that organization.

Definitions

"Printed Products" refers to any physical items produced by North Craft Foundry Inc. through our 3D printing services.

"EngiNova Tool" refers to our online preparation platform that lets users upload models, images, and text to generate ready-to-print files.

"User Content" means any models, images, text, instructions, or other materials submitted by you through the Services.

Eligibility and account responsibilities

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must promptly notify us of any unauthorized use of your account or other security breaches by emailing support@northcraftfoundry.com.

Orders and production

All orders for Printed Products are subject to acceptance by North Craft Foundry Inc. We may reject any order for any lawful reason, including technical limitations or violations of these Terms.

Production timelines are estimates and may vary based on order complexity, material availability, or force majeure events. We will notify you of material delays when practicable.

Orders cannot be modified once production has begun. Cancellation requests received before production starts may be accommodated at our discretion and may result in service fees.

Use of the EngiNova tool

The EngiNova Tool is provided to help you prepare ready-to-print files. You are solely responsible for reviewing the automated output before submitting it for production.

By uploading User Content, you grant North Craft Foundry Inc. a non-exclusive, worldwide, royalty-free license to host, process, print, and otherwise use the User Content solely for the purpose of fulfilling your order.

You represent and warrant that you own or have obtained all rights necessary to upload the User Content and to authorize us to process, print, and deliver the resulting Printed Products.

You must not upload malicious code, offensive material, or content that infringes on the intellectual property, privacy, or other rights of any third party. We may remove or refuse any User Content that violates these Terms.

Design review and limitations

We review User Content for technical feasibility, but we do not verify functional suitability, safety, or compliance with regulatory standards. You are responsible for ensuring the Printed Products meet your requirements and applicable laws.

Tolerance, surface finish, and color may vary from renderings generated by the EngiNova Tool. Minor cosmetic variations are not considered defects.

North Craft Foundry Inc. is not liable for damage or injury caused by misuse of Printed Products or by your failure to comply with design and handling guidelines.

Pricing, payment, and taxes

Prices displayed through the Services are subject to change without notice. The price applicable to an order is the price in effect at the time the order is accepted.

Payment is due at checkout unless we authorize alternative terms in writing. We may suspend production or delivery if payment cannot be processed.

You are responsible for all applicable taxes, duties, and customs fees associated with your order.

Shipping and delivery

Shipping estimates are provided for convenience only and are not guaranteed. Risk of loss transfers to you upon our delivery of Printed Products to the carrier.

Inspect all shipments promptly upon receipt. Report any shipping damage or discrepancies within five (5) days of delivery.

Returns and reprints

Due to the custom nature of 3D printed items, we do not accept returns except where required by law.

If a Printed Product deviates materially from the approved specifications due to our manufacturing error, contact us within ten (10) days of delivery with supporting documentation. We may offer a reprint or refund at our discretion.

We are not responsible for defects arising from design files supplied by you or from misuse, improper storage, or modifications made after delivery.

Intellectual property

Except for User Content, all right, title, and interest in the Services and Printed Products, including software, designs, trademarks, and other materials, are owned by North Craft Foundry Inc. or our licensors and are protected by intellectual property laws.

Nothing in these Terms transfers ownership of your User Content to us. Any suggestions or feedback you provide may be used by us without obligation to you.

Confidentiality

We treat User Content as confidential to the extent necessary to provide the Services. We may share User Content with trusted production partners solely to fulfill your order, subject to confidentiality obligations comparable to ours.

Data protection

We process personal information in accordance with our Privacy Policy, available at

. By using the Services, you consent to such processing.

Prohibited uses

You may not use the Services to produce items that are unlawful, harmful, or intended for weaponization, nor may you attempt to reverse engineer, interfere with, or gain unauthorized access to the Services.

We reserve the right to suspend or terminate access to the Services if we suspect misuse or violation of these Terms.

Disclaimers

EXCEPT AS EXPRESSLY PROVIDED IN WRITING, THE SERVICES AND PRINTED PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you to the extent prohibited by law.

Limitation of liability

To the fullest extent permitted by law, North Craft Foundry Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising out of or related to the Services.

Our total liability for any claim arising under these Terms will not exceed the amount paid by you for the order giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless North Craft Foundry Inc., our affiliates, and our respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.

Term, suspension, and termination

These Terms remain in effect while you access or use the Services. We may suspend or terminate your access to the Services at any time for violation of these Terms or to comply with applicable laws.

Upon termination, sections of these Terms that by their nature should survive will remain in effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to the services or terms

We may modify the Services or these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or any transactions under them.
